Role Summary (The Defender & Strategist): To establish, build, and supervise the company's litigation and dispute resolution function from the ground up. This role shifts the company from being reactive to proactive in conflict management. The core focus is to strategize defense or prosecution, manage high-stakes disputes, and collaborate tightly with the Commercial Legal team to "litigation-proof" contracts and early-stage correspondences.
Key Responsibilities:
- Dispute Strategy & Management (The Case Commander): Formulate end-to-end strategies for all major disputes (civil, criminal, administrative, and arbitration). Determine whether to settle, mediate, or aggressively litigate based on commercial realities and risk assessments.
- Pre-Litigation & Notice Strategy: Intervene early in potential disputes. Draft, review, and strategize critical Notices of Default or termination letters. Ensure that the "paper trail" is strategically designed to provide the strongest possible foundation before a case reaches the court.
- Commercial Support & Contract Fortification: Act as a critical "sparring partner" to the Commercial Legal and Business teams. Review high-risk contracts to identify loopholes and operational flaws based on actual litigation experience.
- External Counsel Management: Evaluate, select, and manage external litigation law firms. Act as the bridge between external litigators and internal management, translating complex court proceedings into business impact, while strictly managing legal fee budgets.
- Team & System Building: Establish SOPs for dispute handling, evidence preservation, and litigation reporting. Plan and execute the hiring and mentorship of junior litigators to build a robust internal litigation team.
Distinction: Highly specialized in conflict resolution and strategic defense. Focuses on minimizing damage or maximizing recovery, rather than commercial deal-making.
Qualifications:
- Education: LL.B. required. Lawyer’s License (ใบอนุญาตให้เป็นทนายความ) is mandatory. Thai Barrister-at-Law (เนติบัณฑิตไทย) is highly desirable and will be considered a strong advantage.
- Experience: Minimum 10-15 years of solid litigation and dispute resolution experience.
- Background: Extensive background as a Litigator in a reputable law firm. In-house experience in managing corporate disputes is highly desirable. Must possess strong tactical thinking, aggressive yet practical negotiation skills for settlements, and a deep understanding of court proceedings, arbitration, and enforcement processes.
